PUBLIC OFFER AGREEMENT / TERMS AND CONDITIONS

These Terms and Conditions constitute a legally binding agreement between you (“User”, “you”, or “your”) and PT BALI BIKE HOUSE, a company duly registered and operating under the laws of the Republic of Indonesia, with its principal office at Jalan Uluwatu II No. 168, Jimbaran, Kuta Selatan, Badung, Bali, Indonesia (“PT BALI BIKE HOUSE”, “we”, “our”, or “us”).

By accessing or using our platform https://balibikehouse.com (the “Platform”) or making a booking through it, you confirm that you have read, understood, and agree to be bound by these Terms and Conditions.

1. DEFINITIONS

Platform: The website https://balibikehouse.com, including all subdomains, mobile versions, and related services operated by PT BALI BIKE HOUSE.
Rental Company / Partner: Third-party providers of vehicles (motorcycles, cars, etc.) or services listed on the Platform.
User: Any individual or entity using the Platform to browse, book, or otherwise engage with rental services.
Booking: A reservation made by the User for the use of a rental unit or other service through the Platform.
Commission: The fee invoiced by PT BALI BIKE HOUSE for services rendered as intermediary or direct rental provider.

2. SCOPE OF SERVICES

PT BALI BIKE HOUSE provides:

Direct rental services for certain units owned or operated by PT BALI BIKE HOUSE.
Marketplace services allowing third-party rental companies to list their units (motorcycles, cars, homes, etc.) and receive bookings from users.
Marketing, client acquisition, and management tools for rental companies.

Bookings may be fulfilled either by PT BALI BIKE HOUSE or by a third-party Rental Company, as specified in the listing.

3. ROLE OF PT BALI BIKE HOUSE

When acting as a marketplace, PT BALI BIKE HOUSE is not the owner or operator of the listed units and is not a party to the rental agreement between the User and the Rental Company.
In these cases, we serve as a booking intermediary and may facilitate communication and payment between the parties.

4. USER RESPONSIBILITIES

Users must provide accurate personal information when making a booking.
Users must comply with the terms set by the Rental Company or PT BALI BIKE HOUSE (e.g., driving license, insurance, rental period, damage policy).
Users are responsible for any damage, loss, or traffic violations during the rental period.

5. BOOKING, PAYMENT & COMMISSION

All bookings are subject to availability and mutual confirmation between the User and the Rental Company (or PT BALI BIKE HOUSE if acting as the provider).
A booking is considered confirmed only after all relevant details have been agreed upon by both parties (e.g., dates, unit, delivery, driver requirements, etc.).
Payment is completed after the booking is confirmed, not at the time of the booking request.
Commission is not deducted per booking. Instead, PT BALI BIKE HOUSE invoices Rental Companies monthly for confirmed bookings facilitated through the Platform.
Currency and Payment (IDR). All prices, fees, deposits, penalties, delivery/pickup charges, and any other amounts shown on the Website and charged in connection with bookings in Indonesia are denominated and payable in Indonesian Rupiah (IDR).
Estimated currency display. The Website may display estimated equivalents in other currencies (e.g., USD, EUR, AUD, RUB) for convenience only. Such amounts are non-binding estimates based on indicative exchange rates and do not change the transaction currency, which remains IDR.
Foreign cards and conversion. If you pay using a payment instrument issued in a currency other than IDR (including foreign cards), your bank, card issuer, or payment provider may apply its own exchange rate and fees. We are not responsible for any differences between the estimated display and the final amount shown by your bank or payment provider.
Receipts and records. Booking confirmations, invoices, receipts, and our internal accounting records are issued and maintained in IDR.
Cash payments (if applicable). Where cash payment is accepted, it is accepted in IDR only.
Taxes. Unless explicitly stated otherwise, prices displayed include/exclude applicable taxes as shown during checkout/booking. Any bank or payment-provider fees are separate and remain the customer’s responsibility.

6. CANCELLATION AND REFUNDS

Cancellation policies vary depending on the unit and the Rental Company.
Details of applicable cancellation terms will be shown during the booking process.
Refunds, if applicable, will be processed within a reasonable timeframe, subject to payment provider terms and confirmation by the service provider.

7. LIABILITY DISCLAIMER

PT BALI BIKE HOUSE is not liable for:
- The condition, availability, legality, or performance of any unit or service provided by a Rental Company.
- Damages, injuries, or losses incurred by the User during the use of a rented vehicle or service not directly owned or operated by PT BALI BIKE HOUSE.
In cases where PT BALI BIKE HOUSE is the direct rental provider, our liability shall be limited to the amount paid by the User for the specific booking.

8. USER CONDUCT

Users agree not to:

Engage in unlawful activity through the Platform.
Misuse the booking system (e.g., spam, fraudulent bookings).
Post misleading or defamatory content in reviews or messages.

9. INTELLECTUAL PROPERTY

All content on the Platform (logos, texts, images, software) is the intellectual property of PT BALI BIKE HOUSE or its licensors and may not be copied, distributed, or used without written consent.

10. MODIFICATIONS

We reserve the right to update or amend these Terms and Conditions at any time. Continued use of the Platform after changes are published constitutes acceptance of the new terms.

11. GOVERNING LAW AND JURISDICTION

These Terms and Conditions are governed by and construed in accordance with the laws of the Republic of Indonesia. Any disputes arising from this agreement shall be settled by the competent courts in Badung, Bali.
