<br/> <br/> <br/> <h1>Rental agreement conditions</h1> <h3> Please read carefully the following conditions of this rental agreement between PT BALI BIKE HOUSE (the “Company” or “Lessor”) and the renter (the “Renter”). </h3> <ol> <li>The Renter must hold a valid vehicle driver’s license (Indonesian SIM C) or an International Driving Permit recognized by Indonesian authorities for vehicle use. The license must be valid for the entire rental period.</li> <li>It is mandatory under Indonesian law that both the Renter and any passenger wear helmets at all times while riding the vehicle. Any fines or legal consequences arising from non-compliance are solely the Renter’s responsibility.</li> <li>The Company will provide helmets. If any of the helmets or extra items are lost or broken, the Renter will be charged the replacement cost as per the new item’s value.</li> <li>The vehicle must be returned on the agreed date and time. If the Renter wishes to extend the rental period, payment for the extension must be made in advance. Failure to pay in advance may result in an additional fee equal to one full day’s rental rate plus 20% of the daily rate.</li> <li>The vehicle is strictly intended for on-road use only. Driving on beaches, fields, or any off-road paths is prohibited.</li> <li>Full payment for the chosen rental period is due upon receiving the vehicle. If the Renter returns the vehicle prior to the end of the rental period, no refund will be provided. In certain cases, a partial refund may be offered at the Company’s discretion.</li> <li>The Renter is liable for any damage they cause to the vehicle. If the vehicle becomes inoperable due to the Renter’s negligence or fault, the Renter shall cover the repair costs. Additionally, the Renter may be charged for documented lost rental income until repairs are completed, up to a reasonable maximum or until the Company obtains a comparable replacement vehicle.</li> <li>The Renter is fully responsible for the vehicle and must not lend or sub-rent it to any third party. The Renter cannot allow any other person to operate the vehicle unless explicitly approved in writing by the Company.</li> <li>The Renter shall inspect the external condition of the vehicle before taking possession. Any pre-existing damage must be noted on the inspection form (attached or provided by the Company) to avoid liability for those damages at the end of the rental.</li> <li>The Renter must return the vehicle in substantially the same condition as when received. Any damages, missing parts, or loss will be charged according to the Company’s documented repair or replacement costs.</li> <li>The Renter is fully responsible for their own safety, health, and compliance with traffic laws while operating the vehicle. In case of an accident or damage, the Renter must immediately notify the Company and provide all relevant information.</li> <li>If any damage occurs, the Renter must report it to the Company within 24 hours, including all relevant details (date, time, location, parties involved, etc.). Failure to do so may result in an additional administrative penalty of up to 50% of the repair cost, to cover increased risk and handling.</li> <li>In the event of an incident resulting in damage or injury to third parties, the Renter bears full responsibility, unless otherwise covered by protection (see Clause 14).</li> <li>Unauthorized repairs are strictly prohibited. If the Renter has the vehicle repaired without the Company’s prior written consent, the Company may charge the Renter for any costs required to restore the vehicle to standard, plus an administrative fee. In emergency situations (e.g., punctured tire), the Renter may perform or arrange basic repairs but must inform the Company immediately.</li> <li>The Renter is responsible for any tire damage caused by punctures or road hazards and must cover the repair or replacement cost.</li> <li>A safety deposit may be required prior to releasing the vehicle to the Renter. The exact deposit amount will be specified in the rental agreement or invoice.</li> <li>The minimum rental period for vehicles is three (3) days. Any bookings shorter than this period may be subject to special terms or may be disallowed.</li> <li> <span>Cancellation Policy.</span> <ul> <li>Before Rental Start: If the Renter cancels prior to taking possession of the vehicle, a cancellation fee of up to 50% of the total rental cost may apply.</li> <li>After Rental Start (Early Return): No refunds will be issued for early returns.</li> <li>Exceptions: If the scheduled rental is less than 3 days or on a special monthly package, cancellation terms may differ and should be clarified separately with the Company.</li> </ul> </li> <li> <span>It is prohibited to drive the vehicle outside Bali without the Company’s express written approval.</span> <ul> <li>The Renter must submit a request at least 72 hours in advance, detailing the travel dates, route, and contact of any accompanying persons.</li> <li>Original vehicle documents will only be provided upon an additional security deposit.</li> <li>The amount of this deposit will be determined by the Company.</li> </ul> </li> <li>The Renter may not allow any other person to drive or operate the vehicle unless specifically approved in writing by the Company.</li> <li>*At the end of the rental period, the Renter must return the vehicle personally. Failure to do so will result in a 1.000.000 IDR penalty.</li> <li>In the event of total loss or theft of the vehicle, the Renter is liable for the fair market value of the vehicle at the time of loss (or 100% of the new vehicle value if the vehicle is under six (6) months old). If the vehicle is more than six (6) months old, the liability will reflect the average secondary market price.</li> <li>If the Renter loses a key (including smart key/keyless), they will be charged the actual cost of replacement or duplication. Exact costs may vary depending on the key type and dealer pricing.</li> <li>If the vehicle’s registration or other official documents are lost while in the Renter’s possession, the Company will charge a replacement fee of 850.000 IDR.</li> <li>The Company’s operational hours are from 10:00 to 20:00 daily. Delivery and pickup typically occur between 09:00 and 19:00. Any delivery or pickup outside these hours may incur an additional fee. The Renter must provide the exact location, time, and other details at least 24 hours in advance.</li> <li>For deliveries or pickups outside the standard area or operational hours, consult the Company in advance. Additional fees of approximately 150.000-300.000 IDR (one-way) may apply, depending on distance.</li> <li>If the Renter violates any terms of this agreement, the Company reserves the right to reclaim the vehicle immediately without refund.</li> <li> <span>Liability & Force Majeure</span> <ul> <li>The Renter acknowledges that riding a vehicle involves inherent risks and agrees that the Company shall not be held liable for any injury, loss, or death arising from the Renter’s or a passenger’s own negligence or traffic violations.</li> <li>This exclusion of liability does not extend to injuries or damages caused directly by the Company’s proven negligence (e.g., failing to maintain the vehicle’s basic roadworthiness).</li> <li>The Company is not liable for any failure to perform its obligations caused by events beyond its reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, or civil unrest.</li> <li>The Company is not liable for any illegal conduct or actions taken by the Renter in violation of Indonesian law.</li> </ul> </li> <li>Protection. Unless otherwise specified in a separate clause or policy, the Company does not provide personal accident or comprehensive vehicle protection under this agreement. The Renter bears full responsibility for third-party liability, personal injury, and property damage if no external protection coverage is in place. The Renter should confirm any existing protection policy or purchase one independently, if required.</li> <li>Governing Law & Dispute Resolution. This agreement is governed by the laws of the Republic of Indonesia. Any dispute arising from or related to this agreement shall be resolved amicably. If no settlement is reached, disputes shall be settled in the competent court located in Denpasar, Bali, unless both parties agree to alternative dispute resolution (such as mediation or arbitration).</li> </ol> <br/> <h3>By signing below, the Renter acknowledges that they have read, understood, and agree to all the terms and conditions stated above.</h3>
